A Dhaka court has expressed embarrassment over continuing to hear the case filed against cricketer Nasir Hossain and his wife Tamima Sultana Tammi and has ordered its transfer to another court.

Additional Chief Metropolitan Magistrate Wahiduzzaman on Monday issued this order, citing time constraints and the impact on other cases.

Both Nasir and Tamima were present in the court for their defense hearing. Their lawyer Adv Azizur Rahman Dulu submitted two petitions, including one accusing the plaintiff’s lawyer, Ishrat Hasan, of contempt of court over her media comments regarding the case.

The plaintiff`s counsel countered, alleging that the defense lawyer had previously represented the plaintiff and was therefore disqualified from representing the defense under legal ethics.

After hearing both sides, the court remarked, "This is a busy court. We lack the time and patience that a case like this requires, and it is affecting other cases. I feel embarrassed. Therefore, I am transferring this case." The case has been forwarded to the Chief Metropolitan Magistrate (CMM) to assign it to another court. Both parties raised no objection to the transfer.

The case stems from a complaint filed by Tamima’s former husband Rakib Hasan in February 2021. He alleged that Tamima married Nasir while still legally married to him, a violation of both religious and state laws. Rakib further claimed that Nasir enticed Tamima away, causing severe emotional distress to him and their eight-year-old daughter.

Earlier, on February 9, 2022, the court framed charges against Nasir and Tamima, while discharging Tamima’s mother, Sumi Akter, from the case. Attempts to revise the charges were rejected by the court in February 2023, allowing the trial against Nasir and Tamima to proceed.

Ten witnesses, so far, have testified in the case.
